AND CONDITIONS

ARTICLE I: COMPANY AND WEBSITE Operator (hereinafter referred to as the “Company”):

The services provided by Enchions are for informational and educational purposes only, as set forth in Article X.

Consent to Terms: By using Enchions’ services, the member automatically agrees to these terms and conditions. No explicit confirmation (e.g., checking the box to agree) is required. If the member does not agree to these terms and conditions, the member may not use Enchions’ services.

Article II: Membership Enchions

Services are only available to persons over 18 years of age (or the age of majority in the country of use). Membership is established by a complete and duly completed registration via the form on the website. Members are required to provide true and accurate information during registration. By submitting the form, the member confirms the accuracy of the information provided.

Article III: Services Enchions provides the following services:

1.Telegram notifications

1.1. Members will be added to the Telegram group within 24 hours of payment being credited.

1.2. Enchions Software generates informative notifications sent via Telegram. The use of this information is at the sole discretion of the member. Enchions is not responsible for any financial gains or losses incurred by the member.

2. IBKR API Connection (hereinafter referred to as the “Software”)

2.1. The Member shall set up a VPS (e.g. at www.forpsi.com) or use his own server (hereinafter referred to as the “Server”) at his own expense. He shall provide the necessary data for the installation of the Software.

2.2. The Server must be available 24 hours a day, 7 days a week, without automatic updates or other interventions preventing smooth functionality.

2.3. The Server must use the Windows or Linux Ubuntu 22 operating system.

2.4. Enchions will launch the Software within 7 days of receiving payment, Server data and confirmation of an active account with Interactive Brokers (IBKR).

2.5. The Member acknowledges that a minimum starting capital of CZK 70,000 is required in the IBKR account for full use of the Software, with the recommended capital being CZK 100,000.

2.6. If the capital falls below 50,000 CZK, the Software will be automatically deactivated until the capital is increased back above this limit.

2.7. The Member is obliged to follow all provided manuals (text or video). Enchions is not responsible for service interruptions or technical problems related to VPS, IBKR or other third-party platforms.

2.8. The use of the Software is at the Member's own risk. Enchions does not guarantee profits or the success of trading strategies.

2.9. The Member acknowledges that the API connection is primarily used for his own strategy. If he uses the Enchions strategy, he assumes full responsibility for the trading results.

2.10. Multiple parallel trades: If the Member wants to operate multiple simultaneously open positions, he must purchase as many licenses (memberships) as the positions he will open.

Example: For one open trading thread, the Member pays 1x monthly fee (1,800 CZK). If he wants to have two parallel positions, he pays 2× 1,800 CZK, i.e. 3,600 CZK per month.

3. Payments for Enchions services

3.1. Telegram notifications

The monthly fee is 1,500 CZK.
The member can cancel the subscription at any time.
The services will be available until the end of the already paid period.

3.2. IBKR API – own server Monthly fee: 1,800 CZK for each open trade (see point 2.10).

One-time fee: 10,000 CZK for API installation.
The member can cancel the subscription at any time.
The services will be available until the end of the paid period.

3.3. IBKR API – Profit Share

The member enters into a special agreement to pay 20% of the profit share from the member’s trading account to Enchions.
On the 1st of each month, the member will receive an invoice for 20% of the profit with a maturity of 7 days.
If the result for a given month is zero or negative, no invoice will be issued.
The member may cancel the cooperation at any time, the services will run until the expiration of the paid period.

3.4. Connecting the API to another broker

Enchions will connect the API to the broker chosen by the member, if technically feasible.
One-time fee: CZK 10,000.
If the API cannot be connected, Enchions will refund the fee in full within 14 days.

3.5. PCF OL TSL on own instrument

Monthly fee: 2,500 CZK for each open trade.
One-time fee: 10,000 CZK for API installation.
If the API fails to connect, Enchions will refund the fee in full within 14 days.
Enchions is not responsible for trading results.

3.6. External applications:

All services are operated via external applications.
No information may be visible in the member account on the website.

3.7. Making services available to third parties (other than the member) is prohibited and may lead to immediate termination without compensation. Sharing access or unauthorized distribution of content is also considered a serious violation. In such a case, Enchions reserves the right to demand a contractual penalty of 50,000 CZK, if permitted by applicable law.

ARTICLE IV:

MEMBER ACCOUNT

Each account is personal and may not be shared with other users. It is prohibited to use the same account on multiple devices at the same time, unless the nature of the service expressly allows it.
Enchions reserves the right to request verification of the member’s identity in the event of suspicious activity (e.g. repeated logins from different geographical locations).

ARTICLE V:

FEES AND SUBSCRIPTION

The Services are subject to a fee (hereinafter referred to as the “Fee”) and are charged for a certain period (“Subscription”).
Access to the Services is enabled after payment has been credited to Enchions’ account, unless otherwise agreed.
Enchions’ maximum liability to the member for any damage or loss shall not exceed the amount paid by the member for the last three months of use of the service.

Article VI:

Consumer Protection

If the member is not an entrepreneur, consumer rights apply to him.

Article VII:

Complaints and Refunds
Claims for refunds can be made within 15 days of the termination of membership.
Enchions does not guarantee specific service results and refunds do not apply to losses caused by trading.

ARTICLE VIII:

TERMINATION OF MEMBERSHIP

A member may terminate membership at any time without being entitled to a refund of the fee already paid.
Enchions may terminate membership in violation of these terms and conditions without compensation and without further notice.

Article IX:

Privacy Policy

Enchions processes personal information in accordance with U.S. federal and Wyoming state laws.

DISCLAIMER

Enchions Services are provided for informational and educational purposes only and do not constitute investment advice or an offer to invest.
Trading always involves risk and historical performance is not a guarantee of future results.
Enchions is not a registered investment advisor and does not provide individual investment recommendations.

Article XI:

Dispute Resolution and Governing

Law All disputes arising from these Terms and Conditions shall be governed by the laws of the State of Wyoming, USA.
Any legal claims or actions must be brought exclusively in the courts of the State of Wyoming, USA.

ARTICLE XII:

FINAL PROVISIONS

Enchions reserves the right to change these Terms and Conditions.
Changes shall become effective upon publication on www.putcallflow.cz.
Enchions is not responsible for outages or other technical difficulties that are entirely within the competence of third parties (e.g. Telegram, Interactive Brokers, VPS provider).

By using the Enchions Company services, the member confirms that he/she has read, understands and agrees to these terms and conditions. If he/she does not agree to them, he/she is not authorized to use the Enchions Company services.

3. Payments for Enchions services

3.1. Telegram notifications

The monthly fee is 1,500 CZK.

The member can cancel the subscription at any time.

The services will be available until the end of the already paid period.
